Terms of Service
These Terms of Service ("Terms") govern access to and use of the Flowvenue S.r.l. website ("Flowvenue"), and the online services connected to it ("Services").
By accessing or using the Site or Services, the User ("User") accepts these Terms and the related Privacy Policy, drafted in compliance with Regulation (EU) 2016/679 ("GDPR") and other applicable regulations on personal data protection.
1. Scope of Application
- These Terms exclusively govern navigation of the Site and use of accessory Services (documentation, community, AI tools, demos).
- The use of the Flowvenue CRM product (including software, APIs and SaaS solutions) is governed by separate agreements entered into with each customer or partner.
2. User Account
- To access certain features, it is necessary to create a personal account, providing truthful, complete and updated data.
- Registration is prohibited if you are under 18 years old or do not have the legal capacity to enter into contracts.
- Business accounts created by administrators may be subject to additional rules established by the organization they belong to.
- The User is responsible for the confidentiality of their credentials. In case of unauthorized use, the User must immediately notify Flowvenue.
3. Community and Content Sharing
- Participation in Flowvenue forums, blogs, events or communities implies the possibility of sharing content with other users.
- Published content is considered public: Flowvenue does not guarantee the confidentiality of such information.
- The User declares to have the necessary rights to publish their content and grants Flowvenue a non-exclusive, worldwide, free, transferable and irrevocable license to use them for the purposes of providing Services and brand promotion.
- The User indemnifies Flowvenue from any liability arising from violations of third-party rights related to published content.
4. Use of AI Tools and Demos
- AI tools made available by Flowvenue are for informational and demonstrative purposes only.
- Automatically generated information does not constitute professional, legal or contractual advice.
- Flowvenue does not guarantee the accuracy, completeness or timeliness of AI-generated content. The User must independently verify its correctness before relying on it.
5. User Conduct
The User undertakes not to use the Site and Services for:
- illegal activities or contrary to applicable EU, international or local regulations;
- violating third-party rights (including copyright, trademarks, patents or personality rights);
- disseminating illegal, misleading, discriminatory or offensive content;
- compromising the security or proper functioning of Flowvenue systems;
- unauthorized access to data, systems or accounts of other users.
Flowvenue reserves the right to suspend or disable accounts and content in case of Terms violation.
6. Intellectual Property
- All intellectual property rights relating to the Site, Services and content (software, logos, texts, graphics, trademarks, databases) are the exclusive property of Flowvenue or its licensors.
- It is forbidden to copy, modify, distribute or use such content without prior written authorization, except as permitted by imperative legal rules.
7. Personal Data Protection
Flowvenue processes Users' personal data in compliance with GDPR, applicable national regulations and, where relevant, extra-EU regulations (e.g. CCPA for users in California, LGPD for users in Brazil).
The User has the right to access, rectify, delete, limit processing, data portability and objection. The methods for exercising these rights are indicated in the Privacy Policy.
8. Warranty Exclusions
The Site and Services are provided "AS IS", without warranties of continuous availability, absence of errors or suitability for a particular use.
Flowvenue does not guarantee that content is always accurate, updated or free from interruptions.
9. Limitation of Liability
Within the limits permitted by law, Flowvenue is not liable for indirect, incidental, consequential or special damages (including loss of profits, data or opportunities).
Nothing in these Terms excludes or limits Flowvenue's liability for fraud, gross negligence, death or personal injury resulting from its own negligence, or any liability that cannot be excluded by law.
10. Terms Modifications
Flowvenue may update these Terms for legal, technical or organizational reasons. Changes will take effect from their publication on the Site. Continued use of the Site constitutes acceptance of the changes.
11. Third-Party Links
The Site may contain links to external resources. Flowvenue exercises no control over such sites and assumes no responsibility for their content or practices.
12. Applicable Law and Dispute Resolution
If the User resides in the European Economic Area (EEA), these Terms are governed by Italian law, with competent forum being the place of residence or domicile of the consumer, if located in the EEA.
If the User resides outside the EEA, Italian law applies and the exclusive jurisdiction of the Milan Court, except for mandatory provisions of local law.
